Landmark Ottawa Royalty Free End User Licensing Agreement

Your right of usage under this agreement is the non-exclusive, non-transferable right to use or publish the photograph in whole or in part in any advertising or marketing materials on behalf of the end user mentioned in the purchasing agreement.

You can publish the image for any use including brochures, ads, billboards, CD covers, Internet, intranet, extranet, annual reports, news letters, books or magazines, television or video projects, etc. The only thing you cannot do with our imagery, without a further resale license, is resell the image directly or create objects based on the image, this includes postcards, calendars, greeting cards, framed prints, posters and T-shirts.

You cannot resell or give away the image or the rights to the image, and you cannot publish it in any way that's pornographic or defamatory. You agree to take all reasonable steps necessary to prevent any third party or staff members from duplicating or distributing any photographs licensed from Landmark Ottawa.

Limited Warranty

Landmark Ottawa warrants that the product or file to be free of defects in material and workmanship for 30 days from delivery.

Your sole and exclusive remedy for a breach of this warranty is the replacement of the file or a refund of the purchase price, at the option of Landmark Ottawa.

Landmark Ottawa makes no other warranty nor agrees to any other condition, representation or undertaking, either express or implied, of any nature, including as to merchantability, satisfactory quality, fitness for any particular use or compatibility with any computer or other kind of equipment.

Neither Landmark Ottawa nor any of its company officers, agents or employees shall be liable to any distributor or other reseller, customer, end user or other person or any indirect, incidental, special or consequential damages (including loss of profit, business, revenue, goodwill or anticipated savings) resulting from its performance or non-performance of this Agreement or the use of, or inability to use the file provided under this Agreement or arising (or which might be claimed) under any other cause of action or theory of claim.

Moreover, the liability of Landmark Ottawa, its agents and employees in respect of any other cause of action (whether arising in tort, contract or otherwise and notwithstanding any negligence or other fault) shall in no event exceed the sales value of the product or file.
